Terms & Conditions

1. Nature of the service

FreeMarket is an online advertising platform. It is not an estate agent within the meaning of the Estate Agents Act 1979, does not provide estate agency services, and does not act as an intermediary in property transactions. The platform does not value, broker, verify, market, view, or hold money for any property.

2. Sellers' obligations

Sellers warrant that they are entitled to market the property, that all information in their listing is accurate and not misleading, and that they comply with all applicable laws including the Digital Markets, Competition and Consumers Act 2024, the Consumer Protection from Unfair Trading Regulations 2008, and (where applicable) the Housing (Scotland) Act 2006. Sellers acknowledge that providing false or misleading material information may be a criminal offence.

3. Buyers' position

Buyers must conduct their own due diligence. Information on listings is provided by sellers and not verified by FreeMarket. FreeMarket makes no warranty about the accuracy or completeness of listing content.

4. Listing fee

£20 per listing, valid for 180 days from the date of approval. The listing fee is non-refundable except where required by law.

5. Removal of listings

FreeMarket may remove any listing at its discretion without refund, including for inaccuracy, fraud, abuse, or breach of these Terms. Sellers may withdraw their own listing at any time from their dashboard; no refund will be issued for the unused portion of the listing period.

6. Limitation of liability

FreeMarket's aggregate liability to any user arising from or in connection with these Terms or the use of the platform is limited to the listing fee paid by that user. FreeMarket is not liable for any direct, indirect, or consequential losses arising from inaccurate or fraudulent listings, failed transactions, or any communications between buyers and sellers.

7. Data and privacy

Personal data is processed in accordance with our Privacy Policy. Buyer contact details submitted via the contact form are shared with the relevant seller for the purpose of facilitating contact only.

8. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.

9. Changes to these terms

FreeMarket may update these Terms from time to time. Continued use of the platform following any changes constitutes acceptance of the updated Terms. Where changes are material, we will notify registered sellers by email.
